LEGAL BASIS FOR DATA PROCESSING
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter GDPR), the Organizer is obliged to process, in a secure manner and only for the specific purposes listed below, the personal data collected via the online platform https://fixcluj.eu.
The Regulation is directly applicable in all EU member states, protecting the rights of all natural persons within the EU. In material terms, the Regulation applies to all controllers processing personal data. It does not apply to data processing that concerns legal persons, particularly companies with legal personality, including their name, type, and contact details.
Personal data is defined as any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.
Processing of personal data refers to any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means—such as collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, alignment, restriction, erasure, or destruction.

In accordance with Article 4(7) of the Regulation, which defines a “controller” as the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of processing personal data, the Data Controller for this website is:

PURPOSE OF DATA PROCESSING
The Organizer processes personal data collected directly from users/visitors/applicants/interviewees/participants using automated means.
Personal data will be processed for the following purposes:

Collecting necessary information for the registration of applicants in the FIX Cluj – Edition III Project;

Validating and verifying the accuracy of data submitted through the application form;

Communicating via email or phone about administrative matters (e.g., next steps in the application process, schedule or location changes, updates about future editions);

Keeping fiscal/accounting records, as required by applicable law;

Ensuring transparency in procedures and actions/events conducted as part of the FIX Cluj project;

Sending newsletters;
-
Participation in pitch sessions, training, events, etc., organized within FIX Cluj (Edition III);

Marketing communications from sponsors.
Processing is conducted in accordance with the GDPR and is based on the data subject’s consent, contract performance, or the legitimate interests of the Controller (except when overridden by the data subject’s fundamental rights, especially in the case of minors).
DATA PROCESSED
By accessing and using https://fixcluj.eu, your device may automatically send information to the hosting server. The following data may be collected under Article 6(1)(f) GDPR – the legitimate interest of the Controller:

Browser and operating system used, and name of access provider.
Personal data may also be collected directly through the application form. This may include, under Article 6(1)(a) GDPR – the explicit and unequivocal consent of the data subject:

Information related to ideas, services, products, affiliated persons, etc.;

Identification data (ID number, CNP, address, issuance date, photo, etc.);

Any other data requested via the application form or follow-up communications from the project Organizer.
DATA CONSENT
Processing must be based on a legitimate legal basis (e.g., consent, contract performance, legal obligation). Consent must be freely given, specific, informed, and unambiguous—provided through a clear statement or affirmative action (e.g., checking a box).
Sponsor marketing communications are optional and only occur with separate, explicit consent. In this case, the sponsors’ privacy policies apply.
DISCLOSURE OF PERSONAL DATA
The data may be shared only with:

Public/private entities (e.g., Rural Senses) involved in oversight or support of the Organizer’s activities;

The Organizer's partners and collaborators involved in implementing FIX Cluj – Edition III;

The IT service provider ensuring the functionality of the project platform;

Where the data subject has given explicit consent (Art. 6(1)(a) GDPR);

Where necessary to fulfill a legal obligation;

Where required for legitimate interests, except where overridden by the data subject’s rights.

DATA SUBJECT RIGHTS
Under GDPR, you have the following rights:

Right to be informed – about the processing activities, the controller, and recipients of your data;

Right to erasure ("right to be forgotten") – where data processing is unlawful or other legal grounds apply;

Right to restriction – in certain situations, like contesting data accuracy;

Right to object – to processing based on legitimate interests;

Right to data portability – to receive or transfer your data in a readable format;

Right to file a complaint or take legal action – with the National Authority for the Supervision of Personal Data Processing or in court;

Right to withdraw consent – at any time, affecting only future processing;

Right not to be subject to automated decisions or profiling – and to request human intervention or express your point of view.

FINAL PROVISIONS
Access to personal data is granted only to authorized personnel, solely to fulfill their duties under the stated purposes, and under confidentiality obligations.
The Organizer and the server provider have implemented physical, electronic, and administrative procedures to protect collected data.
The site uses SSL encryption for secure data transmission. You can recognize this by the padlock symbol and the https:// prefix in the browser bar. Once active, this encryption prevents third-party access.
In the event of a personal data breach, the Organizer will comply with GDPR and notify both the affected individuals and the supervisory authority within 72 hours, unless Article 34(3) of GDPR applies.
